The Greater Mohali Area Development Authority (GMADA) has named its first residential urban estate in the vicinity of the upcoming international airport as Aero City Mohali. A total of 3,950 plots, ranging between 125 square yards (5 marla) and 500 square yards (1 kanal), will be allotted through a draw of lots at a reserve price of Rs 12,000 per square yard (Rs 3 lakh per marla).
The application form attached with this brochure along with self attested passport size photograph and self attested declaration should be submitted to branch of ------------------------------ as mentioned in advertisement either in person or by post on or before the closing date along with earnest money in the shape of crossed bank draft in favour of Estate Officer, GMADA, SAS Nagar payable at respective branch. Application found incomplete or defective in any respect or which are not duly signed by the applicant are liable to be rejected.
TERMS OF APPLICATION
1.    Submission of application is no guarantee of allotment.
2.    Conditional applications will not be considered.
3.    Submission of false/fabricated documents shall attract criminal proceedings.
4.    GMADA reserves the right to increase or decrease the number of plots prior to holding draw of lots depending upon the feasibility at site.
5.    GMADA further reserve the right to change the facilities, specifications, locations etc. and also the right to withdraw the scheme.
6.    While corresponding with GMADA, applicant is required to quote his application form number, scheme, amount deposit, receipt number etc. as may be relevant.
7.    Details of drawings and specifications or any other information concerning the scheme can be obtained from the Estate Officer, GMADA, SAS Nagar.
8.    The allottee shall abide by the terms and conditions of allotment as contained in the brochure, allotment letter and any other terms and conditions revised/amended by the GMADA from time to time.
9.    GMADA shall not be responsible for late receipt of application after due date/time.
MODE OF ALLOTMENT
1.    In case number of applications received less than the number of plots available in a category, all the applicants will be issued Letter of Intent subject to their being eligible otherwise. However, plot number shall be allotted through draw. In case number of applications received is more than the number of plots available under a particular category then draw of lots will be held.

 
For the purpose of draw all applications will be included in the draw of lots category-

1.    wise, without scrutiny of the applications.  Thereafter, only the cases of successful applicants will be scrutinized. On scrutiny, the applicant is found eligible, a letter of intent will be issued. 

 
2.    Where the applications are more than the number of plots then a waiting list in order of seniority will be drawn to the extent of 5 % of the number of plots available under each category. The plots so made available under this scheme will be offered to the applicants in the waiting list in order of their merit. The applicants in the waiting list shall be made allotment only after completing the process of allotment of eligible applicants. However the applicants kept on waiting list will be given allotment in the event of surrender of plot under scheme only.

 
3.    The waiting list will be valid for one year from the date of draw.

 
4.    If the requisite number of applications is not received in a reserved category the plots shall be offered to those belonging to the general category.
Delayed Payment
1.    In case of advance payment which is no less than the next due instalment, the remaining instalment shall be rescheduled.
2.    Part payment of any instalment will not be accepted. In case of non-payment of instalments by due date, allottee shall be liable to pay penalty on the amount due at the following rates for the delayed period:-
1
Upto one year

 
Normal applicable rate of interest + 3% P.A. for delayed period
2
If the delay is upto 2 years
Normal applicable rate of interest + 4% P.A. for delayed period
3
If the delay is upto 3 years or more
Normal applicable rate of interest + 5% P.A. for delayed period
1.    In case of enhancement of price partly paid plots due to increase in area, enhancement of land compensations for any other reason, the increased price shall be added to the balance payment scheduled subject to the conditions stipulated in sub-para (vi) below.
2.    In case of fully paid plot, the enhancement of price due to any or all the above reasons, shall be paid within 60 days without payment of any interest of such demand or in 3 equal six monthly instalments along with an interest @10% per annum.
3.    In case of reduction in area, the excess amount shall be refunded/adjusted, as the case may be, on pro-rata basis within a period of 60 days.
4.    All payments shall be made by a bank draft drawn in favour of Estate Officer, GMADA, SAS Nagar payable at any local branch. Payment by cheque shall not be accepted. Details of LOI number/plot number, area, sector and Urban Estate should be indicated both in the forwarding letter and on the back of demand draft for avoiding any misuse.
5.    No separate notice for payment of installment shall be sent.


1.    Receipt in respect of all payment received shall be issued within a period of 15 days.
2.    GENERAL CATEGORY

Eligibility
o    Must be a citizen of India.
o    Must have attained the age of maturity i.e. 18 years as on date of submission of application.
o    The applicant himself/herself or any member of his/her family should not own any residential plot/house/flat allotted by any Government Agency at SAS Nagar. This means the person who has purchased plot/flat/house by way of auction or re-sale is eligible for submitting his or her application. The definition of family means husband/wife, as the case may be, including children (less than 18 years).
RESERVE CATEGORIES
The eligibility criteria for the reserved categories will be as under in addition to a,b,c of Para-I above:-
4.            The beneficiary will not be entitled for allotment of plot under the scheme once he has already availed the benefit for allotment under the reserved category in any other scheme/station from any Govt. Agency.
5.            Applicant under reserved category must be a domicile/residence of Punjab. The applicant will have to submit Domicile Certificate/Residence Certificate issued by the concerned Tehsildar/ Executive Magistrate of Punjab Government or any officer authorized by the Government for residing in Punjab atleast for the last 5 years from the date of publication of the scheme. 
6.            All plots declared surplus in any of the reserved categories or where sufficient applications are not received against the reserved category,  shall stand transferred to the general category at the time of allotment.
i) Scheduled Caste/Scheduled Tribes
A valid certificate issued by a competent authority as prescribed by the Govt. of Punjab is required.

ii) Physically handicapped/blind:
Should be 40% or above disabled or 100% blind to be certified by the concerned Civil Surgeon of the District. 5% rebate/discount of the total price of the plot shall be given to this category.
 

iii) Freedom Fighter:
Should be recipient of Freedom Fighter pension or Tamra Patra issued by Punjab Govt./Govt. of India. A valid certificate issued by the concerned Deputy Commissioner of the District, shall be attached with the application form.
 

The following order of preference will be adopted:-
7.            Self
8.            Widow of the Freedom Fighter who is drawing the pension.
9.            Freedom Fighter's son/daughter and grandson/daughter.
iv) 
a) Defence/Paramilitary forces/Legal Heirs of Army/Paramilitary forces, Punjab Police Personnel killed in action (war or on law and order duty).

b) 100% Disabled Soldiers of Punjab domicile
In case of war widows, serving defence personnel and ex servicemen/ paramilitary forces a valid certificate issued by the Deputy Director Distt. Sainik Board is required. In case of Punjab Police Personnel, a valid certificate issued by the DGP, Punjab/D.C. as the case may be, is required.





v) Gallantry Award Winners:
o    The Gallantry award winners from the defence services, paramilitary forces who have distinguished themselves by acts of bravery and velour in the defence of our Country, both in war and peace time and Punjab Police Personnel awarded with President Police Medals for Gallantry and Police Medals for Gallantry. They should not already have received any such discretionary quota plot/house from any other scheme in any other part of the Country and also should not possess any plot/house in urban estate, SAS Nagar.

 
o    In case of posthumous award, the next of kin shall be eligible to avail of this quota. The next of kin shall be construed as widow (if there is only one) and in case the awardee was unmarried, the mother or father in that order.

 
o    The following order of preference will be adopted: (i) Param Vir Chakra
(ii) Maha Vir Chakra
(iii) Vir Chakra
(iv) Ashoka Chakra
(v) Kirti Chakra
(vi) Shaurya Chakra
(vii)President Police Medals for Gallantry
(viii) Police Medals for Gallantry
(ix) Sena Medal/Nau Sena Medal/Vayu Sena Medal
       The higher category awardee shall get preference over the lower category awardee.
Sports Persons:
Should be Medal winners of Olympics, Common Wealth or Asian Games, Mountaineers scaled Mount Everest and possess the requisite certificate awarded by the Indian Mountaineers Foundations duly countersigned by the Ministry of Youth Affairs and Sports, Govt. of India.
POSSESSION AND OWNERSHIP
1.    Possession of plot shall be handed over to the allottee after completion of development works at site not later than 2.5 years. If GMADA fails to deliver the possession within stipulated period then 10% interest shall be given on the deposited amount.  
2.    The ownership of the land shall continue to vest with Greater Mohali Area Development Authority until full payment is made of outstanding dues in respect of said plot.
3.    Within 90 days of payment of entire money as per (b) above, allottee shall be required to execute a Deed of Conveyance in prescribed format and prescribed manner. The expenses of registration and execution of Conveyance Deed shall be borne by the allottee.
4.    The Letter of Intent may be transferred  by way of sale, gift or otherwise with the prior permission of Estate Officer, GMADA, SAS Nagar subject to the payment of 1% of the total reserve price.

CONSTRUCTION OF BUILDING
1.    Construction on plot shall be completed within a period of 3 years from the date of issue of allotment letter after getting the building plans duly sanctioned from the Estate Officer, GMADA, SAS Nagar.
2.    Construction shall be carried out as per sanctioned Building Plans and as per the provision of PUDA (Building) Rules, 1996 as amended from time to time.
Any construction carried out in violation of sanctioned building plan/building rules shall be

1.    dealt with as per policy laid down in this regard from time to time.
2.    Before occupying the building, allottee would be required to obtain completion certificate/ occupation certificate from the Estate Officer, GMADA. SAS Nagar.
EXTENSION FEE
 If the construction on the plot is not completed within the stipulated in para IX above, extension in construction period would be granted subject to payment of extension fee, as may be determined from time to time. However, extension fee in period of completion of building shall be subject to the satisfaction of the Estate Officer that the failure to complete the building within the stipulated period was due to a cause beyond the control of allottee.
GENERAL
1.    The allotment will be made under the provisions of Punjab Regional & Town Planning & Development Act, 1995 and regulations & policies made there under.  The allottee shall be bound by the provisions of this act and rules/ regulations/policies/orders passed under the same and as amended from time to time and shall do all acts  in consonance thereof besides being in consonance with the terms and conditions of allotment letter.
2.    The price is tentative and is subject to variation with reference to the actual measurement of site as well as in the event of enhancement of compensation by the Courts under the land Acquisition Act, 1894 and increase in the cost of development including amenities or otherwise.  The allottee will be liable to pay the additional price of the site, if any, so determined by GMADA within thirty days of its demand and in case of default, the allottee shall be liable to pay the interest as per policy of GMADA and in addition to any other action which the GMADA may take.
3.    In case of breach of any condition(s) of allotment or of regulations or non-payment of any amount due together with the penalty the plot or building as the case may be, shall be liable to be resumed and in that case an amount not exceeding 10% of the total amount of consideration money, interest and other fees payable in respect of plot shall be forfeited as per the provision of section 45(3) of the Punjab Regional and Town Planning & Development Act, 1995 (hereinafter to be called the Act).
4.    No fragmentation of the site shall be permitted.
5.    The allottee shall pay all general and local taxes, rates, process imposed or assessed on the said site/building by the Municipal or any other authority competent to levy such taxes and rates.
6.    The GMADA may , by its officers and servants at all reasonable times and in reasonable manner after giving 24 hours notice in writing enter in any part of the plot./building erected thereon for the purpose of ascertaining that the allottee has duly performed and observed the conditions of allotment and provisions under the Punjab Regional and Town Planning and Development Act, 1995 and rules and regulations made there-under.
7.    The GMADA shall have full rights, powers and authority at all times to do through its officers or servants all acts and things which may be necessary and expedient for the purpose of enforcing compliance with all or authority of the terms and conditions and reservation imposed and to recover from the allottee as first charge upon the said site, the cost of doing all or any such act and things and all cost incurred in connection herewith or any way relating therewith.
8.    Any change in address must be notified by registered A.D. to Estate Officer, GMADA, SAS Nagar.
DISCLAIMER
          In case for whatsoever reason, this scheme fails GMADA will refund the deposited money to the applicant without interest.  GMADA shall not be liable for any claim/damages if there is any delay in implementation of the scheme. GMADA shall not be liable for any claim, whatsoever, on this account.


DISPUTES
      Subject to the provisions of the Act all the disputes and/or differences which may arise in any manner touching or concerning this allotment shall be referred to the Sale Arbitrator, Chief Administrator, Greater SAS Nagar Area Development Authority (GMADA) of any person appointed/nominated by him in this behalf. The award of such Arbitrator shall be final and binding on the parties. Arbitration shall be governed by the Arbitration and Conciliation Act, 1996, as amended from time to time.
ACCEPTANCE OR REFUSAL OF ALLOTMENT
1.    In case terms and conditions of allotment, as detailed above, are acceptable, allottee is required to send his/her acceptance by registered post along with a demand draft of 15% price of the plot within 30 days of issue of Letter of Intent (excluding date of issue) subject to the conditions.
2.    In case of refusal to accept the allotment offer then such refusal in writing through a registered post should be received within 30 days from the date of issue of Letter of Intent. In the event of such refusal to accept the Letter of Intent, then 10% of earnest money deposited shall be forfeited. However, in case such refusal is received after a period of 30 days from the issue of Letter of Intent offer, entire earnest money deposited shall be forfeited.
Note: 
          Only one application can be given by a person or his/her spouse. But one applicant can apply for different category of plot (size wise) on separate application forms. In that case earnest money will be charged with each application form by the applicant would be entitled to only one plot. In case the applicant is successful in more than one category then in that case he/she will have to surrender the other plot after giving option for retaining one with him/her within 30 days from the date of publication of the result of draw, failing which Estate Officer, GMADA, SAS Nagar will have the right to cancel any of extra plot/plots and entire earnest money shall be forfeited. However, if they surrender all of their plots, their case will be dealt as per the provisions mentioned in the preceding Para in respect of each surrendered plot.

Note:

TERMS & CONDITIONS:
1.    10% price of plot is to be deposited alongwith application.
2.    15% price of plot is payable within thirty days from the date of issue of Letter of Intent.
3.    5% price + additional price, if any of the plot is payable at the time of delivery of possession. 
4.    Balance 70% would be payable in the following payment plan
PAYMENT PLAN

PLAN-A
If the allottee deposit the balance 70% price in lump sum within 60 days from the date of allocation/Letter of Intent, rebate shall be allowed @10%.

PLAN-B
Allottees are entitled to pay the 70% amount without interest in seven bimonthly equated installments started from the date of issue allocation/Letter of Intent.
 

PLAN-C
Allottees are entitled to pay the 70% amount alongwith interest @10% p.a. in 7 half yearly instalments started from the date of allocation/Letter of Intent.
 

NOTE
If the allottees under the Plan B and C makes the payment in lumpsum at any time then a rebate of 5% shall be allowed on the balance outstanding amount.
